ESMA Act Invocation for LPG Supply in India

On March 10, 2023, the Indian government took significant steps to address the ongoing challenges in the supply of liquefied petroleum gas (LPG) due to geopolitical disruptions, particularly the West Asia Conflict. This situation prompted the invocation of the Essential Commodities Act (ESMA Act) to ensure the uninterrupted supply of domestic cooking gas.

Government Actions

The Union Government directed refineries and petrochemical units to maximize LPG production, focusing specifically on domestic use. The Ministry of Petroleum and Natural Gas emphasized the need for higher production levels, stating, “In light of current geopolitical disruptions to fuel supply and constraints on supply of LPG, Ministry has issued orders to oil refineries for higher LPG production and using such extra production for domestic LPG use.” This directive aims to prioritize domestic LPG supply to households, thereby ensuring energy security.

To facilitate this, the government established a 25-day inter-booking period to prevent hoarding and black marketing of LPG. Additionally, natural gas supply was prioritized for certain sectors, with fertilizer plants required to maintain seventy percent of their past six-month average gas consumption. Gas marketing entities were instructed to ensure eighty percent gas supply to tea industries and other industrial consumers.

Current State of LPG Supply

As of now, City Gas Distribution entities must also maintain eighty percent gas supply to industrial and commercial consumers. However, oil refining companies have been ordered to reduce their gas allocation to approximately sixty-five percent of their past six-month gas consumption. This regulatory framework aims to balance the needs of various sectors while ensuring that domestic consumers have access to essential LPG supplies.

Importance of the ESMA Act Invocation

The invocation of the ESMA Act is a critical measure in the current context, as it regulates the availability and equitable distribution of petroleum products and natural gas. Every producer, importer, transporter, marketer, or distributor of natural gas is now required to furnish information to the Central Government, enhancing transparency and accountability in the supply chain.

This sequence of events underscores the government’s commitment to maintaining energy security in the face of external challenges, ensuring that households and essential industries continue to receive the necessary fuel supplies.
